BN Digital provides enterprise software development, design, AI/ML implementation, and related consulting services. The Service includes our website, published content, and any related tools or platforms we operate.

5. Client services and engagements

Service engagements with BN Digital are governed by separate agreements (e.g., Statements of Work, Master Service Agreements). These Terms of Service apply to the use of the website and do not supersede any client engagement agreements.

6. Estimates and project delivery

Initial project estimates provided by BN Digital are indicative and not binding commitments. Due to the complexity of digital product development, work is structured on an hourly basis unless explicitly agreed otherwise in writing. Detailed terms are set out in the applicable service engagement agreement.

7. Data retention and handover

Upon completion of a project engagement, the following retention periods apply unless otherwise agreed:

  • Source code repositories: hosted for 3 months
  • Environments: maintained for 10 days
  • Container images: stored for 1 month
  • Design files and documents: retained for 1 month

Clients are responsible for arranging handover and backup of deliverables within these periods.

8. Third-party services

The Service may contain links to third-party websites or services that are not owned or controlled by BN Digital. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.

9. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. BN Digital does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by applicable law, BN Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

You agree to indemnify and hold harmless BN Digital, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service or violation of these terms.

12. Governing law and jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are based in the United States, certain consumer protection laws of your state of residence may apply in addition to the above.
